the president spoke with house speaker john boehner by phone yesterday. it was their first conversation in a week but neither side would characterize that conversation. they agreed not to talk about it publicly. there is this, though, on the front page of today's "washington post." many gop centrists and some conservatives are calling on house speaker john boehner to concede on rates now while he still has leverage and shows concern. ed, as we dive in on this post article, it goes down to points out the republicans do want something in return for this. they want to have some wins in this fight. perception is reality in washington, d.c. and across the land. so if they can give something that looks like, okay, we got a couple things out of this. but that's really not going to be the case when we look at the whole big picture, unless they do that two step, which is get the 98% out of the way and maybe fight over the next eight weeks before the debt ceiling debate. >> well, this is where i think the white house needs to continue to put the pressure on boehner

i say to my friend john boehner you control matters on the floor, no one else does. you have the ability and you're the only one that has the ability to put this on the floor for a vote. he should do that. that would be the american way. >> house speaker john boehner and senate majority leader harry reid on the fiscal cliff standoff. "the new york times" reporting gop leaders are considering extending tax cuts for the fiscal class to avert the fiscal cliff but if that is the case republicans are staying very tight lipped about it. joining me is senator ben carden from maryland a member of the budget committee and the committee on finance. good to have you here and you have said one thing you want from these talks is to show the markets and to show leaders, that leaders have the situation under control there, in your estimation, how would you say that's going so far? >> well predictability is very important. i think the first step is exactly what leader reid said. if we can get predictability on the taxable income below $250,000, everyone knows that's under current ra

but something as you saw there from orrin hatch and speaker john boehner that has been rejected. so, the senate has passed a bill that follows the president's wishes that extends the bush era tax cuts for the bottom 98%, but does not extend them for the top 2%. those couples filing jointly making more than $250,000 a year. so, it's past the senate and gone no where in the republican-controlled house. what are the options available? nancy pelosi digging into the playbook as you reported with something called a discharge petition. if a majority of the members of the house sign this petition, then the speaker of the house, of the majority party, of course, is forced to put something on the floor that he does not want to put on the floor. i have to tell you, craig, sort of a hail mary and it hasn't worked for ten years when mccain feingold was put on the floor of the house by virtue of the fact that they had a discharge position. it has been tried hundreds of times in the past 100 years. it very seldom works. you can see now, democrats trying everything nay can do. putting on public
